*The biggest risk when buying in Mallorca — especially with fincas. Estimates: ~30,000 buildings on suelo rústico in the Balearics were erected wholly or partly illegally.*
Golden rule: A land-registry entry does NOT prove planning-law legality. Adeclaración de obra nuevacan be registered even though the building never had a permit. Always check separately at the town hall (certificado urbanístico/cédula urbanística).
Official certificate from the Consell Insular (Mallorca: Consell de Mallorca) confirming that a dwelling is habitable. Mandatory in the Balearics.
Ley 5/2018. 🔎 Correction: the Catalan Decreto 141/2012 does not apply in the Balearics.
or 2.20 m in ancillary rooms (bathroom/kitchen/hallway) ✅; minimum dwelling usable floor area 36 m² 🟡; at least one bedroom of 8 m² 🟡; ventilation/light (≥ 1/10 of the floor area), sanitary facilities. 🔴 The frequently cited "6 m² single room" could not be substantiated.
reform.
Utility connection (water/electricity/gas), letting, ETV licence, sale (waiver only by an express renuncia before the notary). Without a valid cédula a property is practically not mortgageable.
Learning: Renewing an expired cédula may require costly upgrades (energy, installations, accessibility — 🟡 EU EPBD tightening 2024/25). Estimate the costs in advance.
infracción urbanística = planning-law breach (unauthorised extension, pool, guest house →fine, demolition order, no cédula, no utilities).
fuera de ordenación = the building conflicts with the plan. Where the breach is time-barred it is tolerated, butnot legal — only maintenance, no extension; if erected after 1.3.1987 without a licence: no electricity/gas/water connection.
On ordinary suelo rústico, breaches generally become time-barred after 8 years. On protected suelo rústico (ANEI/ARIP/AANP/LIC) they do NOT become time-barred (Ley 12/2017) → perpetual demolition risk. 🔴 A citable TSJ Balears leading judgment with a case number is still pending (→ Ch. 23), but the doctrine itself is settled.
🔎 Important correction: "AFO" (Asimilado a Fuera de Ordenación) and "Ley 6/2023" belong to Andalusia (LISTA, Ley 7/2021) — not to the Balearics. In the Balearics the procedure is called legalización extraordinaria under Decreto-ley 3/2024 of 24.05.2024.
Procedure (Balearics): 1. Applies to fuera de ordenación buildings on suelo rústico whose breach is time-barred (on protected land: buildings before 2014). 2. Activation per island by a plenary resolution of the Consell (the Consell de Mallorca has resolved to do so). 3. Application deadline: max. 3 years from BOIB publication; decision: max. 6 months. 4. Technical project + environmental conditions (wastewater treatment, energy/water efficiency, light pollution). 5. Fees + a special economic contribution to the municipality (🔴 the exact percentage is still open). 6. Consequence: toleration, utility connection, land-registry entry become possible — but an express prohibition of tourist letting of the object thus legalised.
Learning: "No partial legalisation" — you cannot register only the legal part. Do not build the purchase price on an uncertain legalisation; on protected land, drop any legalisation hopes. Have the legalisability checked before the purchase contract by an architect.
LUIB distinguishes infracción (sanction/fine) and restablecimiento (restoration/ demolition):
(that is the state default deadline). No time-barring of restoration on suelo rústico (under Art. 196.2 a) LUIB on *any* rústico, not only protected — unlike under the predecessor norm LOUS), as well as for BIC/catalogados. 🟡 Leading-judgment example: STSJ IB 326/2021 (rústico común, demolition upheld; → Ch. 23).
caducidad of the procedure (Art. 195.1): The authority has 1 year from initiation toissue a decision — otherwise later decisions are void (a defence lever, even where the infraction is not time-barred).
coste de ejecución material/PEM): 10% (1st year), 12.5%(2nd year), 15% (3rd year); plus ICIO + licence fees. 🟡 50% reduction for low income.
suelo rústico protegido (no time-barring → not legalisable), dominio público/coastal protection zones, anything with a demolition order, uses subject to an interés general requirement.
registry → a legalised rústico villa = no ETV potential**.
🔴 The circulating figure "minimum plot of 200,000 m² in ANEI" is wrong: in ANEI new residential construction is simply prohibited (no m² threshold). → Ch. 10.
What is the cédula de habitabilidad and why does it matter? The Balearic habitability certificate (valid for 10 years). Without it: no utility contract, no ETV licence, hard to sell, not mortgageable.
Can I legalise an illegal house in Mallorca? Sometimes — via the legalización extraordinaria (Decreto-ley 3/2024), where the breach is time-barred. On protected suelo rústico nothing becomes time-barred → a permanent demolition risk.
